Domestic Private Adoption

Generally a domestic private adoption is when a United States Citizen family adopts an infant born within the United States.

The adoptive family will make a legal agreement with the biological parent(s) to adopt the child. The adoption itself must be validated by the appropriate court. It will terminate the parental rights of the biological parent(s) and imbue those rights in the adoptive parent(s).

Generally adoptive families contract with either an agency or an attorney representing the biological parent(s) and proceed from there.  Situations may even be advertised in a local newspaper.  It can be possible to adopt a relative child through this process.

  •  You need not use an Adoption Service Provider (“ASP”).
  • You will need a positive home study to complete a domestic private adoption
  • Generally domestic private adoptions are completed by an adoption agency and/or an adoption attorney.
  • They must all be legalized in court.
  • Situations can be found through adoption agencies, adoption attorneys, or sometimes advertisements.
  • Generally at least one birth parent must travel to the state in which the child is born.
  • The Interstate Compact on the Placement of Children (“ICPC”) applies if you are not a resident of the state in which the child is born.
  • Infants may be available for adoption through domestic private adoption.
  • Domestic private adoption can be quite costly.
